The Committee on Legislative Support of Law Enforcement recommends that Verkhovna Rada should adopt the draft resolutions on the peculiarities of dismissal of prosecutors and investigation officers that were involved in conducting criminal proceedings against participants of protest actions and other mass events, as well as junior enlisted and senior officers of internal affairs bodies and military men that participated in securing public order and other events in the course of protest actions and other mass events.    

In view of preventing illegal use of the right to retirement from prosecutor’s bodies on the part of the abovementioned investigation officers and prosecutors, the Verkhovna Rada is recommended to adopt the draft resolution (Reg. No. 4210) under which:

“Retirement from the prosecutors’ office of investigation officers that conducted investigation of crimes against participants of protest actions and other events, as well as prosecutors that monitored adherence to the laws in the course of pre-trial investigations in the form of managing the pre-trial investigation, or moved the court to take preventive measures regarding the abovementioned measures is allowed only if the conclusion is given, following the results of a functional audit, that they did not violate their oath, the Constitution of Ukraine and the laws of Ukraine.    

 Commissions to carry out the abovementioned functional audits shall be established by the decision of the Prosecutor General of Ukraine.”

The Committee recommends also that the Parliament should adopt the draft resolution on the peculiarities of dismissal of prosecutors, investigation officers, as well as junior enlisted and senior officers of internal affairs bodies and military men that participated in securing public order and other events during mass protests and other mass events (Reg. No. 4211).
